On one of my favorite blogs Legal Insurrection was the news that advantaged journalist and 1%’er David Gregory, whose children go to a school with armed guards, but who is personally “anti-guns” will not be prosecuted for violating the DC anti-gun law on national TV. Please go and read the whole thing on Professor Jacobson’s site.
This is another flagrant display of the “do as I say not as I do” DC crowd et al. The people who believe or at least promote the “for thee not for me” mantra of the progressive who believes somehow they know more than you, are more capable than you and proceed to tell you what to do and how to do it, generally with a law attached to it to force you to do it their way. Like a malevolent Burger King whopper giving it to you “their way.
As Professor Jacobson points out in his blog, David Gregory will NOT be prosecuted for violating DC’s gun law. As you will recall Mr. Gregory brandished a cartridge on Meet the Press on Dec. 23, 2012. Here is what Professor Jacobson wrote:
“Gregory goes free “despite the clarity of the violation of this important law”
“Just released by D.C. Attorney General there will be no prosecution of David Gregory despite a finding that there was a clear violation of the law (emphasis is Professor Jacobson’s):
Having carefully reviewed all of the facts and circumstances of this matter, as it does in every case involving firearms-related offenses or any other potential violation of D.C. law within our criminal jurisdiction, OAG has determined to exercise its prosecutorial discretion to decline to bring criminal charges against Mr. Gregory, who has no criminal record, or any other NBC employee based on the events associated with the December 23,2012 broadcast. OAG has made this determination, despite the clarity of the violation of this important law, because under all of the circumstances here a prosecution would not promote public safety in the District of Columbia nor serve the best interests of the people of the District to whom this office owes its trust. Influencing our judgment in this case, among other things, is our recognition that the intent of the temporary possession and short display of the magazine was to promote the First Amendment purpose of informing an ongoing public debate about firearms policy in the United States, especially while this subject was foremost in the minds of the public following the previously mentioned events in Connecticut and the President’s speech to the nation about them. There were, however, other legal means available to demonstrate the point and to pursue this line of questioning with the guest that were suggested to NBC and that could have and should have been pursued.
OAG also appreciates that the magazine was immediately returned to the source that NBC understood to be its lawful owner outside of the District and that the magazine in question, with NBC’s assistance, has been surrendered to MPD. OAG also recognizes the cooperation NBC has provided in the investigation of this matter.”
We are quickly becoming NOT a nation of laws but a nation of men…NOT a nation where all laws are the same for ALL men, but a nation of advantaged people where the law applies “unless”… an oligarchy; where advantaged people get a political pass for breaking the law depending on 1)who they know. 2)who they are or 3)what they can do for numbers 1 & 2. Does that sound just a tinge cynical? Well it is, because THAT is what is being displayed every day across the “fruited plains” of America, from sea to shining sea displayed in full living color on almost EVERY MSM outlet, cable news show & the internet every single day.
This is NOT what the Founders had in mind when they wrote the Founding documents. Even IF Mr. Gregory had been charged and given a fine with a trip to a courtroom, it would have been sufficient to make sure that the spirit AND the letter of the law had been upheld. As it stands now, one only needs to be famous or an advantaged to get the privilege of getting a “get out of prosecution” card.
